Code of Conduct

This Code of Conduct is part of our Terms & Conditions. 

 

Introduction

SmoothTC wishes to ensure the best possible experience for all its clients and has established the following Code of Conduct. Further, the Client agrees to the following Terms of Service (“Terms”), which govern the Client use of all SmoothTC’s software, applications, and services (collectively, the “Services” or “STC Services”). As used herein, the terms “SmoothTC”, “STC”, “Contractor” “us,” “we,” or “our” mean SmoothTC , any subsidiary or affiliate of SmoothTC that provides Client any part of the Services, and any employee, agent, independent contractor, designee, or assignee of SmoothTC that we may, at our sole discretion, choose to involve in the provision of the Service (collectively, the “STC Parties”). By accessing and using this website and registering for services, you agree to abide by these standards as follows:

 

Professionalism

  • Fully comply with all applicable state and federal laws, including those specific laws, rules, regulations and codes of ethics that are binding to Tennessee real estate brokers and affiliate brokers as set forth in the Tennessee Real Estate Commission, the Real Estate Broker License Act, and the Code of Ethics of the National Association of Realtors®.

  • Conduct yourself in a professional manner at all times.

  • Provide accurate and up-to-date information concerning your transactions.

  • Keep your transaction coordinator informed of all the details and information related to the transaction that he or she needs.

  • Respect deadlines and respond to inquiries in a timely manner.

  • Provide copies of all documents related to the transaction whether by electronic form found at SmoothTC.com or by email or by providing account access.

 

Integrity

  • Uphold the highest standards of honesty and integrity.

  • Avoid conflicts of interest and disclose any potential conflicts immediately.

  • Ensure confidentiality and privacy of each submitted transaction in addition to the confidentiality and privacy of client and vendor information.

 

Duty of Good Faith & Fair Dealing

  • You acknowledge that the services rendered for transaction coordinating are detailed here and are what your transaction coordinator is expected to provide. Thus, you agree that you will not instruct your TC to perform additional duties outside the scope of representation without providing additional compensation that you are responsible for negotiating with your TC prior to instruction or TC is authorized to bill for such charges pursuant to the Service Agreement.

  • You agree that in the event of any dispute or altercation between you and your TC that you will make every good faith effort to resolve such conflict in a timely and respectable manner.

  • In the event you terminate your TC, you must:

    • Do so in accordance with the Service Agreement.

    • Pay your transaction coordinator for the current transaction unless the termination is with cause as outlined by the Service Agreement.

 

Charges to Clients

  • Only agreed upon costs and charges will be billed to you as defined in the Service Agreement.

  • You are responsible for ensuring the prompt and timely payment of such services at the closing table. If payment is not submitted at the closing table, you have five (5) business days to tender payment for services rendered.

  • We reserve the following rights to late payments as follows:

    • Late payments will trigger a fee of 20% per month on the amount still owed. 

 

Discrimination and Harassment

  • You will not discriminate on the basis of race, color, religion, sex (to include orientation) or engage in any form of sexual harassment.

 

Respect

  • Treat others with respect, regardless of their role or level of experience.

  • Refrain from any form of discrimination, harassment, or bullying.

  • Provide constructive feedback when necessary, avoiding personal attacks or derogatory language.

 

Compliance

  • Ensure that your real estate license is active at all times in which services are rendered by your TC pertaining to the contracted real estate transaction(s).

  • Adhere to all applicable laws, regulations, and guidelines related to the contracted real estate transaction(s).

  • Indemnify your TC for any violation of compliance of an any applicable laws, regulations, and guidelines related to the contracted real estate transaction(s).

  • Follow the Terms & Conditions  of SmoothTC.com.

  • Report any illegal or unethical behavior observed on the site to the administrators.

 

Collaboration

  • Engage in collaborative efforts that contribute positively to the community.

  • Engage in collaborative efforts that contribute positively to the transaction.

  • Share knowledge and experiences to foster professional growth among members.

  • Encourage and support all parties in the contract to close process.

 

Responsibility

  • Take responsibility for your actions whether on the website or in relation to the services rendered.

  • Notify management if you encounter technical issues that may affect your transactions.

  • Provide feedback to improve SmoothTC.com services and resources.

 

Security

  • Protect the security of your SmoothTC account by providing unauthorized access to your account.

  • Report any security breaches or suspicious activities immediately.

 

Enforcement

  • Violations of this Code of Conduct may result in a warning, suspension, or permanent ban from SmoothTC’s website and/or services. The administrators reserve the right to remove any content that does not align with these standards and provide notice.
